Find information for individuals accessing services funded under the Disability Services and Inclusion Act 2023.

About the changes 

This Disability Services and Inclusion Act 2023(Opens in a new tab/window) (DSI Act) will not change or affect the National Disability Insurance Scheme (NDIS) or Disability Support Pension paid under the Social Security Act 1991. The DSI Act establishes a contemporary and streamlined framework to facilitate funding for supports and services that will assist all people with disability regardless of whether or not they are a participant in the NDIS. 

Code of Conduct 

All service providers who are funded through the DSI Act are required to comply with the Code of Conduct from 1 January 2024. This means your provider is required to: 

  • act with respect for the individual rights of people with disability to freedom of expression, self-determination and decision making, in accordance with applicable laws and conventions 
  • respect the privacy of people with disability 
  • provide the activity in a safe and competent manner, with care and skill 
  • act with integrity, honesty and transparency 
  • promptly take steps to raise and act on concerns about matters that may impact the quality and safety of the provision of the activity to people with disability 
  • take all reasonable steps to prevent and respond to all forms of violence against, and exploitation, neglect and abuse of, people with disability 
  • take all reasonable steps to prevent and respond to sexual misconduct. 

This applies to service providers who are funded to deliver disability services and supports through existing and new programs funded by the Department of Social Services, outside of the NDIS.

Information for service users 

The Australian Government has introduced a Code of Conduct (or the Code) to ensure the safety and quality of services for people with disability. The Code applies to all providers and workers delivering disability supports and services funded by the Australian Government.

Services may include, but are not limited to:

  • employment
  • carer supports
  • counselling
  • advocacy.

The Code consists of seven behaviours that providers and workers must follow at all times. As part of their obligations under the Code, they must:

  1. act with respect for the individual rights of people with disability to freedom of expression, self-determination and decision-making, in accordance with applicable laws and conventions
  2. respect the privacy of people with disability
  3. provide the support activity in a safe and competent manner, with care and skill
  4. act with integrity, honesty and transparency
  5. promptly take steps to raise and act on concerns about matters that may impact the quality and safety of the provision of the activity to people with disability
  6. take all reasonable steps to prevent and respond to all forms of violence against, exploitation, neglect and abuse of people with disability, and
  7. take all reasonable steps to prevent and respond to sexual misconduct.

All providers and workers must abide by the Code at all times. There may be consequences if you, a provider or another worker breach the Code. For providers, this may include the termination of your contract or Funding Agreement with the Australian Government. For workers, a breach of the Code may mean the termination of your employment. You may also be prohibited from working in disability services in the future.

You can make a complaint if you suspect an individual or provider has breached the Code. Complaints can be made to:

  • the service provider
  • the Department of Social Services Feedback and Complaints Team or
  • the Complaints Resolution and Referral Service.

All complaints are confidential and can be made anonymously.

The Australian Government remains committed to promoting safe and quality service delivery by setting out expectations for appropriate conduct and behaviour of workers and providers who support Australians with disability.

How to make a complaint 

If you wish to make a complaint about a service funded under the DSI Act, you can lodge it with your service provider. Your service provider is required to have a complaints management process in place.
